To Whom It May Concern: Pursuant to W.Va. Code §29B-1, please provide electronic copies or scans of the records in the possession, custody or control of the West Virginia State Treasurer responsive to the following: 1. Documents or records that show the total number of unclaimed cashier’s checks, including any items identified by NAUPA CODE CK01 received by and/or reported to the Unclaimed Property Division from holders in 2019, 2020 and 2021. 2. Documents or records that show the total dollar value of unclaimed cashier’s checks including any items identified by NAUPA CODE CK01 received by and/or reported to the Unclaimed Property Division from holders in 2019, 2020 and 2021. 3. Dear Ms. Braski: I am writing in response to your request for “documents or records” regarding all outstanding checks currently held by Unclaimed Property division of the West Virginia State Treasurer’s Office regarding NAUPA CODE CK01 for years 2019, 2020 and 2021. The West Virginia State Treasurer’s Office can provide a listing of the names and cities of last known address for unclaimed property owners. You may download the file from the following link into an excel file at no cost: https://www.wvsto.com/FOIA/FOIA04112022.zip. This listing is updated each quarter. However, any further information regarding unclaimed property is exempt from disclosure under the WV FOIA pursuant to W.Va. Code §36-8-25 which provides that: Records of abandoned property kept by the [unclaimed property] administrator are available for inspection and copying only by an owner of such property as to the particular property he or she owns, or by his or her personal representative next of kin, attorney at law or such person entitled to inherit from the owner conducting a legal audit thereof. These records are exempt from the provisions of chapter twenty-nine-b of this code. Further, we are unable to disclose additional information pursuant to W.Va. Code §12-3-1(d), which states as follows: Any information or records maintained by the treasurer concerning any check not presented for payment within six months of the date of issuance is confidential and exempt from disclosure under the provisions of article one, chapter twenty-nine-b of this code, and is disclosable only to the state spending unit authorizing the check, or to the payee, his or her personal representative, next of kin or attorney-at-law. (emphasis added). Regarding any other instructions or requirements, those are determined per claim and provided during the claiming process. We believe we have fully complied with your request and have satisfied the requirements of W.Va. Code §29B-1-1. If you disagree, you may write this Office explaining why you do not believe we have fully complied and ask for further information or documents, or you may seek redress by instituting proceedings for injunctive or declaratory relief in the Circuit Court of Kanawha County, West Virginia.
