Email from Prosecuting Attorney to Mr. Fennimore: ? Dear Mr. Fennimore: I am writing to respond to your FOIA request recently submitted to the Fayette County Commission via email. Please find our responses below: 1. Scoring sheet showing how Vertical Communications performed vs the other vendors who submitted responses and how your organization scored. No such scoring sheets were generated nor used in the process by which the Fayette County Commission made its selection. As such, the Fayette County Commission can't respond to your request as set forth in item number one. 2. Copies of the documents submitted by the final 3 vendors showing their proposed solution details and pricing. As for the information requested under item number two. First, only two vendors complied with the terms and conditions of the telecommunications RFP and as such only two vendors were considered, one of which was Vertical Communications. Second, the Fayette County Commission views the information requested to be exempt from disclosure pursuant to the West Virginia Code §29B-1-4(a)(1). Information submitted by the second vendor was submitted to the Fayette County Commission as a plan to provide telecommunication services and was submitted for the purpose of a proposing services to be provided and a cost in relation thereto. Providing Vertical Communications with a copy of the second vendor's proposal would allow Vertical to obtain a business advantage over its competitor and as such the FCC believes such disclosure is exempt from disclosure under West Virginia's FOIA.
